This Privacy Policy explains how Chert Technologies, Inc. (“Chert,” “we,” “us,” or “our”) collects, uses, and shares personal information in connection with our website at trychert.com and our AI-assisted outbound messaging services (collectively, the “Services”).
Chert provides a full-stack outbound sales service in which AI agents conduct personalized conversations with business prospects on behalf of our business customers, primarily over iMessage and other messaging channels. This policy applies both to (a) customers and website visitors who interact with us directly, and (b) prospects and recipients who receive or respond to messages sent through the Services on behalf of a Chert customer.
1. Information We Collect
Information you provide directly. When you contact us, book a call, sign up, or correspond with us, we collect information such as your name, business email, phone number, company, role, and the contents of your messages.
Customer-provided data. Our customers upload, sync, or otherwise provide information about their target prospects (for example: name, business email, phone number, company, title, and other business-context attributes). Customers represent that they have a lawful basis to share this information with us for processing.
Prospect and conversation data. When the Services contact a prospect, we collect and store the message content exchanged, delivery and response status, timestamps, and any information the prospect chooses to share in reply (including scheduling preferences and contact details).
Lead-sourcing data. To support customer campaigns, we may obtain business-contact information about prospects from publicly available sources and licensed third-party data providers.
Usage and device data. When you visit our website, we automatically collect IP address, browser type, device identifiers, pages viewed, referring URLs, and similar technical data via cookies and analytics tools.
2. How We Use Information
- To provide, operate, secure, and improve the Services;
- To generate, send, receive, and respond to AI-assisted outbound messages on behalf of our customers;
- To schedule meetings and coordinate handoffs to customer sales teams;
- To train, evaluate, and improve our AI models on Chert-internal data (customer content is used to improve service quality only as permitted by the applicable customer agreement);
- To communicate with you about the Services, respond to inquiries, and send product updates you have opted into;
- To comply with applicable laws (including messaging, anti-spam, and consumer protection laws), enforce our agreements, and protect the rights, property, and safety of Chert, our customers, and others.
3. AI & Automated Messaging Disclosure
The Services use artificial intelligence to draft and send messages on behalf of our customers. Conversations may be reviewed by Chert personnel for quality, safety, and compliance purposes. If you are a recipient of a Chert-powered message and would like to confirm whether you are speaking with an AI agent or a human, you may ask, and we will provide an honest response.
4. How We Share Information
We do not sell personal information. We share information only in the following circumstances:
- With our customers. Conversation data and prospect responses are shared with the Chert customer on whose behalf the outreach was sent.
- With service providers (sub-processors). We use vetted third parties to host infrastructure, deliver messages, run AI models, send email, schedule meetings, monitor errors, and analyze usage. These providers are contractually limited to processing data on our instructions. Categories include: cloud hosting and storage, large language model providers, messaging and telephony providers, calendar and scheduling tools, analytics, and customer support tools.
- For legal reasons. We may disclose information when required by law, subpoena, or legal process, or when we believe in good faith that disclosure is necessary to protect rights, safety, or property.
- In a corporate transaction. If Chert is involved in a merger, acquisition, financing, or sale of assets, information may be transferred subject to standard confidentiality protections.
- With your consent or at your direction.
5. Your Choices & Rights
Opt out of messaging. You can stop receiving messages from a Chert-powered campaign at any time by replying STOP (or any similar opt-out term) to the conversation, or by emailing contact@trychert.com with the phone number or email address you would like removed. We honor opt-outs across our customer base for the channel and identifier specified.
Access, correction, deletion, and portability. Subject to applicable law, you may request that we access, correct, delete, or provide a copy of personal information we hold about you, or that we restrict or object to certain processing. To exercise these rights, email contact@trychert.com. For prospect data sourced or held on behalf of a Chert customer, we will generally route the request to the relevant customer (the data controller) and assist them in responding.
California residents (CCPA/CPRA). California residents have the right to know what personal information we collect, the right to delete it, the right to correct inaccuracies, the right to opt out of “sale” or “sharing” (we do not sell or share personal information as those terms are defined under the CCPA), and the right to be free from discrimination for exercising these rights.
EEA, UK, and Swiss residents (GDPR). If you are located in the European Economic Area, United Kingdom, or Switzerland, our legal bases for processing personal data are: performance of a contract, our legitimate interests in operating and improving the Services and conducting B2B outreach, compliance with legal obligations, and your consent where required. You have the right to lodge a complaint with your local supervisory authority.
6. Cookies & Analytics
We use cookies and similar technologies on our website to remember preferences, measure traffic, and understand how the site is used. You can control cookies through your browser settings; disabling cookies may limit some features.
7. Data Security
We maintain administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and vendor due diligence. No system is 100% secure, and we cannot guarantee absolute security.
8. Data Retention
We retain personal information for as long as necessary to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. Customer-controlled data is retained according to the customer’s instructions and the applicable customer agreement. We delete or anonymize data when retention is no longer necessary for these purposes.
9. International Data Transfers
Chert is based in the United States. If you access the Services from outside the United States, your information will be transferred to, stored, and processed in the United States and other jurisdictions in which our service providers operate. Where required, we rely on appropriate safeguards such as Standard Contractual Clauses for cross-border transfers.
10. Children
The Services are intended for businesses and are not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, please contact us so we can delete it.
11. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above and, for material changes, take additional steps to notify you. Your continued use of the Services after the effective date constitutes acceptance of the updated policy.
